W stosunku do sprawozdań finansowych i sprawozdań z działalności za 2008 rok, po raz pierwszy zostaną zastosowane nowe reguły odpowiedzialności za treść sprawozdań, rozszerzające odpowiedzialność za ich treść na członków rady nadzorczej.
Członkowie zarządu i rady nadzorczej mają obowiązek zapewnić, że sprawozdania są zgodne z wymogami ustawy o rachunkowości. Dotychczas odpowiedzialność taka dotyczyła tylko członków zarządu.
W razie gdyby sprawozdania nie spełniały wymogów określonych w ustawie, członkowie zarządu i rady nadzorczej są solidarnie odpowiedzialni wobec spółki za szkodę wyrządzoną działaniem lub zaniechaniem, które stanowiło naruszenie ich obowiązku.
